Former emergency detainees consider compensation claims

At least 25 people formerly held under Preventive Detention Orders during the State of Emergency are considering compensation claims against the State, according to attorney CJ Williams. The development was reported on 15 September, ahead of the emergency period’s scheduled expiry on Thursday, 17 September.

Williams said his firm, Quantum Legal, was advising the former detainees and would examine each person’s circumstances before deciding whether to bring proceedings. He stressed that having been detained does not automatically establish an entitlement to damages.

The report also identified uncertainty over the legal routes available under the current emergency regulations. No court award or successful claim by this group was announced. The possible proceedings remain under consideration, and the report said responses from relevant Government officials were being sought.
